By accessing our website, making an inquiry, submitting a booking request, or confirming a trip with us, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

2. About Our Services

Himalaya Safety Treks provides and arranges trekking, tours, hiking, expeditions, adventure activities, transportation, accommodation, permits, guides, porters, and related travel services.

Some services may be provided by independent third-party suppliers, including hotels, airlines, transportation companies, guides, porters, activity operators, and other local service providers.

We make reasonable efforts to work with reliable service providers; however, the availability and operation of third-party services may be outside our direct control.

3. Booking and Confirmation

A booking request may be submitted through our website, email, telephone, messaging platforms, or other communication channels.

A booking is considered confirmed only after:

• Himalaya Safety Treks has accepted the booking; and

• Any required deposit or payment has been received; and

• Booking confirmation has been provided where applicable.

The information provided by you during the booking process must be accurate and complete.

You are responsible for checking your booking confirmation, itinerary, dates, traveler information, and other relevant details and notifying us promptly of any errors.

4. Payments

The total trip price, deposit requirements, payment schedule, and balance due date will be communicated to you before or during the booking process.

Payments may be made through the payment methods provided by Himalaya Safety Treks.

Where payment is processed through a third-party payment provider, the provider's own terms and conditions may also apply.

Unless otherwise agreed in writing, all applicable charges must be paid within the specified payment deadlines.

Failure to make required payments on time may result in cancellation of the booking and applicable cancellation charges.

5. Prices and Inclusions

Trip prices and package details will be provided in the applicable itinerary, quotation, booking confirmation, or other written communication.

Unless specifically stated, trip prices may not include:

• International or domestic airfare

• Travel insurance

• Visa fees

• Personal expenses

• Personal trekking or climbing equipment

• Additional accommodation caused by delays or itinerary changes

• Meals or services not specifically included in the itinerary

• Emergency evacuation or rescue expenses

• Tips and gratuities

• Additional transportation or accommodation resulting from circumstances beyond our control

• Government fees, permit fees, taxes, or charges introduced after confirmation of the booking

The inclusions and exclusions applicable to your particular trip will be stated in your quotation or booking confirmation.

6. Cancellation and Refunds

Cancellation terms may vary depending on the trip, destination, season, accommodation, permits, transportation arrangements, and third-party supplier conditions.

Applicable cancellation charges and refund conditions will be communicated as part of your booking terms.

Certain costs may be non-refundable once incurred, including permits, transportation bookings, accommodation charges, airline tickets, government fees, or other third-party services.

Where a refund is approved, it will generally be processed after deducting applicable non-refundable costs and cancellation charges.

We strongly recommend purchasing comprehensive travel insurance that includes trip cancellation, medical treatment, emergency evacuation, and other relevant travel risks.

7. Changes to Itinerary

Trekking and adventure travel can be affected by weather, trail conditions, political circumstances, natural events, transportation availability, government regulations, health and safety concerns, and other factors.

Himalaya Safety Treks may modify, postpone, or adjust an itinerary when reasonably necessary for operational or safety reasons.

Where possible, we will provide an alternative arrangement of a comparable nature. However, additional costs arising from traveler-requested changes or circumstances outside our control may be payable by the traveler.

8. Weather, Mountain Conditions, and Safety

Trekking and adventure activities involve inherent risks, including but not limited to:

• High altitude and altitude-related illness

• Extreme or rapidly changing weather

• Snow, ice, landslides, and falling rocks

• Difficult or remote terrain

• River crossings

• Road and transportation conditions

• Delays or cancellations

• Physical exhaustion

• Accidents and injuries

• Limited access to medical facilities

• Emergency evacuation requirements

• Natural disasters and other unforeseen events

You acknowledge these risks when participating in our trekking and adventure activities.

Our guides and staff may make reasonable decisions regarding route changes, rest days, delays, evacuation, or termination of an activity where they believe it is necessary for safety.

9. Health and Fitness Requirements

You are responsible for ensuring that you are physically and medically capable of participating in your selected trip or activity.

You should seek appropriate medical advice before participating in high-altitude trekking, climbing, or physically demanding activities, particularly if you have an existing medical condition.

You must inform us of any relevant medical, dietary, mobility, or other condition that may reasonably affect your safety or ability to participate.

Providing inaccurate or incomplete health information may affect our ability to respond appropriately in an emergency.

10. Travel Insurance

Travel insurance is strongly recommended and may be required for certain trips.

Your insurance should, where applicable, provide adequate coverage for:

• Medical treatment

• Emergency evacuation and rescue

• High-altitude trekking or climbing

• Trip cancellation or interruption

• Lost, stolen, or damaged baggage and equipment

• Personal liability

• Delays and other travel-related risks

Himalaya Safety Treks is not responsible for costs that should reasonably be covered by your travel insurance.

You are responsible for reviewing your insurance policy and ensuring that it provides adequate coverage for your particular trip.

11. Passports, Visas, Permits, and Documentation

Travelers are responsible for ensuring that they have valid passports, visas, permits, travel documents, and other documentation required for their journey.

Where included in our services, Himalaya Safety Treks may assist with obtaining applicable trekking permits, entry permits, visas, or other travel documentation.

Approval of visas, permits, or entry into a country or restricted area is ultimately subject to the relevant government authorities.

We are not responsible for losses resulting from a traveler failing to obtain or maintain the required documentation.

12. Guides, Porters, and Local Service Providers

Guides, porters, drivers, accommodation providers, and other local service providers may be engaged to deliver services included in your trip.

Travelers are expected to treat all guides, porters, staff, local communities, and service providers with respect.

Travelers must follow reasonable safety instructions and local rules provided by our guides or representatives.

13. Traveler Responsibilities

During your trip, you agree to:

• Follow reasonable instructions provided by guides and trip leaders

• Respect local laws, customs, traditions, and communities

• Take reasonable care of your personal belongings

• Respect the environment and protected areas

• Avoid behavior that may endanger yourself or other travelers

• Provide accurate information required for the safe and proper arrangement of your trip

• Maintain valid travel documents and appropriate insurance

• Follow applicable rules relating to trekking routes, conservation areas, national parks, and local authorities

Himalaya Safety Treks reserves the right to refuse or terminate participation where a traveler behaves in a manner that creates a significant safety risk or seriously disrupts the trip.

14. Personal Belongings

You are responsible for your personal belongings, baggage, equipment, valuables, passports, and other possessions during your trip.

Himalaya Safety Treks is not responsible for loss, theft, or damage to personal property except where liability cannot legally be excluded.

We recommend that travelers keep important documents and valuables secure and maintain appropriate insurance coverage.

15. Emergency Situations and Evacuation

In the event of an emergency, accident, illness, severe weather, natural disaster, or other safety-related situation, reasonable steps may be taken to protect the traveler.

This may include changing the itinerary, arranging medical assistance, arranging transportation, or coordinating emergency evacuation where available.

The costs of medical treatment, rescue, helicopter evacuation, additional accommodation, transportation, or other emergency services may be the responsibility of the traveler unless covered by an applicable insurance policy or otherwise agreed in writing.

16. Force Majeure

Himalaya Safety Treks shall not be held responsible for failure or delay in performing services where such failure or delay results from circumstances beyond our reasonable control.

Such circumstances may include:

• Natural disasters

• Earthquakes

• Floods

• Landslides

• Severe weather

• Avalanches

• Political unrest

• Strikes

• War or terrorism

• Government restrictions

• Border closures

• Epidemics or pandemics

• Transportation disruptions

• Changes in government regulations

• Trail or destination closures

• Other unforeseen circumstances beyond our reasonable control

Where such circumstances occur, we will make reasonable efforts to assist travelers and provide alternative arrangements where possible.

Additional costs resulting from such circumstances may be payable by the traveler unless otherwise agreed.

17. Website Information

We make reasonable efforts to ensure that information published on our website is accurate and up to date.

However, trekking routes, prices, schedules, availability, accommodation, transportation, weather conditions, government regulations, and other travel information may change.

We reserve the right to correct errors, update information, and modify website content without prior notice.

20. Environmental and Responsible Travel

Travelers are expected to respect local communities, cultural heritage, wildlife, protected areas, trekking routes, and the natural environment.

Travelers should avoid littering, unnecessary environmental damage, disturbance of wildlife, and disrespectful behavior toward local communities.

21. Limitation of Liability

To the extent permitted by applicable law, Himalaya Safety Treks will not be liable for losses, damages, delays, injuries, expenses, or disruptions arising from circumstances beyond our reasonable control or from the acts or omissions of independent third-party service providers.

Nothing in these Terms & Conditions is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

22. Complaints

If you experience a problem during your trip, you should inform your guide, trip leader, or Himalaya Safety Treks representative as soon as reasonably possible.

Prompt notification gives us a reasonable opportunity to investigate the issue and, where possible, take corrective action.

Any formal complaint should be submitted to us as soon as reasonably practicable after completion of the trip.
